TERMS AND CONDITIONS
2.1 The School's Pledge:

2.1.1 |
ESL4Asia
will provide assistance and guidance where appropriate to
ensure an enjoyable stay and a fruitful experience for the
teacher. |
|
2.1.2 |
It is the
intention of the school to strive to accommodate the
teacher’s
reasonable requests, and come to an
arrangement that is acceptable
to all parties. |
|
2.2.1 |
The teacher will
be responsible for acquiring the initial tourist visa to
Taiwan.
ESL4Asia
shall sponsor the teacher for a working visa. The teacher
shall be responsible for the submission of all relevant
documentation to
ESL4Asia
, who will submit them to the proper authorities. |
|
2.2.2 |
The Teacher will
be responsible for the cost of physical exam (about
NT$1200-1500) for work visa, and for providing personal
passport photos for application. |
|
2.2.3
|
ESL4Asia
will pay for Work Visa Application and processing, which is
about NT$6500. |
|
2.2.4 |
In the case of a
visa trip being required, and it is
ESL4Asia’s
fault delaying the teacher’s working visa, the school will
cover the costs incurred, provided the teacher has provided
all documentation necessary and done everything he/she can
to facilitate processing of work visa. However, if it is due
to the teacher’s fault, not providing enough documents for
the working visa application, then, the teacher is
responsible for the visa trip. It is a must that both party
follow this item strictly in order to keep our work
smoothly. |

2.3 |
Hours of work, Salary & Bonus |
|
2.3.1 |
The
teacher agrees to be available to carry out his/her duties
between the hours of 8:00am to 9:00pm, Monday to Saturday as
advised by the employer. ( Not Saturday afternoon) |
|
2.3.2
|
The working days
are Monday to Saturday, 4 to 5 working hours per day. The
teacher is required to be at the school at least 15 minutes
prior to the class time. |
|
2.3.3
|
The teacher
shall be guaranteed a gross monthly salary of NT$ 50000.
This represents the minimum amount of 100 hours at NT$ 500
per hour. |
|
2.3.4
|
Whichever Chinese New Year falls in, that month is not
guaranteed for 100 hours.
The teacher
will be off for at least a week. That is a good week for
the teacher
to arrange
his/her
travel plan. (Chinese New Year is usually in the end of
January or in February.) It is the teacher’s responsibility
to come back for work as the time assigned after Chinese New
Year. |

2.3.5 |
There is a week
training period for the new teacher. (20 hours)
ESL4Asia
provides class training, observation, and practicum for the
teacher. It is the teacher’s obligation to receive the
training. The school will reimburse meals NT$2000 for the
teacher. |
|
2.3.6 |
The 100-hour
guarantee period begins on the first day of the second
full calendar month of teaching. Prior to this time,
teacher will be paid according to the hours that have
taught. Due to the class training, and the teacher’s own
pace to accommodate to a new environment, teacher may or may
not work full 100 hours during first month. |
|
2.3.7 |
The teacher is
paid on the 10th day of the following month. (Please note
that all pay is taxed according to the Taiwanese tax laws.) |
|
2.3.8
|
NT$3000 per
month will be withheld and put into a trust fund, until the
sum reaches NT$30 000 and will be reimbursed at the
completion of the contract, with 6% APR. (Trust fund might
not be reimbursed to the teacher subject to contract
incompletion.) |
|
2.3.9
|
There
will be a $NT 20000 bonus awarded at the completion of the
contract. |
|
2.3.10 |
The
school will provide some fun occasions to reward teacher’s
hard work every two months. For example, KTV (Song singing),
a day tour in Taiwan, meal meeting…etc. |
|
2.4.1 |
Teaching English should be fun and enjoyable. Teachers can have
their own style and
personality
but must be willing (in most schools anyway) to facilitate
“fun” learning. |
|
2.4.2 |
Teachers will assist and make a
positive contribution to ESL4Asia
by, teaching well and keeping
a good work attendance. |
|
2.4.3 |
Teachers
must make
lesson plans,
course outlines according to each class, as directed by the
Director of Studies or Supervisor.
ESL4Asia
will provide English songs and games for the teacher. It is
the teacher’s duty to learn these English songs and games to
facilitate teaching. |
|
2.4.4 |
Teachers will attend and take action upon
issues raised on both one to one and group meetings
reviewing the teacher’s performance, professional
development, and issues related to the school in general. |
|
2.4.5 |
Teachers are required to be involved and
participate in special promotional events for schools, which
may fall outside of regular work hours. The participation
hours will be
paid.
|
|
2.4.6
|
Teachers
are responsible for the preparation, maintenance, and
submission of timely and accurate reports on lessons and
student progress according to the scheme advised by the
Director of Studies.
|
|
2.4.7
|
Teachers need to substitute teach as cover for absent colleagues
in school or other school locations when required. Teacher
will be compensated
for substitute hours at regular pay. |
|
2.5.1 |
In the event of
the teacher being late or unable to attend class, he/she
must notify the school as soon as possible. If the teacher
is late for class, NT$10 will be deducted per minute late.
If the teacher is absent for the class without early
notification, NT$600 will be deducted per hour for the hours
you have to teach that day. Same rule is applied to a sick
day without a doctor’s proof. (We don’t like teachers just
say “I am sick” as excuse and absent from the class. If you
are truly sick, show us the medicine from the doctor or the
pharmacy.) |

2.5.2 |
The Teacher will
attend class and school activities in proper attire.
Appearance and clothing must be neat and clean. Any
clothing with holes or offensive words/pictures/ graphics
are not allowed. Shorts may be worn if they are neat,
clean, and extend to the knee. Tank tops, cut-offs, and
house sandals are not allowed. |

2.5.3
|
The teacher will
forfeit his/her right to work for any other English Language
teaching organization during the period of this contract. |
|
2.6 |
Health Insurance & Sickness |
|
2.6.1 |
It will be the
responsibility of the teachers to have their own health
Insurance (e.g. Blue Cross) for the
initial waiting period before the work visa has been issued. |
|
2.6.2
|
After the
teachers work visa has been processed, health insurance will
be provided after four months, according to Taiwan
government’s regulation. It is a condition of residence in
Taiwan that all residents are members of the National
Insurance Scheme. Insurance premiums will be deducted from
the teacher’s salary. (About NT$300 per month.)
|
|
2.6.3 |
Time missed due
to sickness or for personal leave will be considered as
unpaid leave and proportional deductions from the teacher’s
salary will be made accordingly. (Please also see
2.5.1) |
|
2.6.4 |
If the teacher
is absent from work from sickness, a doctor’s certificate or
other documentation should be provided. (Medicine from a
pharmacy) |
|
2.7.1 |
The school may
provide free accommodation for the teacher. It is a
furnished apartment. |
|
2.7.2 |
We hire cleaning people to clean the apartment. There is a
monthly cleaning fee deducted from your salary, NT$400.
|
|
2.7.3 |
The teacher will
be responsible for utility charges (phone, electricity and
gas, etc.) |
|
2.8 |
Income Tax Information |
|
2.8.1 |
The normal
income tax rate is 10 per cent in Taiwan. |
|
2.8.2 |
According to
Taiwanese Tax Laws, foreign workers will be taxed at a rate
of 20 percent for the first 183 days of employment. After
the initial 183 days, the tax rate will be reduced to the 10
percent rate bracket. Taxes will be deducted from each
monthly paycheck. The school will provide assistance in
filing the income tax return. |

3.1 |
Disciplinary & Grievance: |
|
3.1.1 |
The teacher will
be on time for class. Tardiness, leaving early or absences
without a reasonable excuse are unacceptable.
|
|
3.1.2 |
Requests for a
personal leave of absence must be made at least 24 hours in
advance. If the employer has not approved the request then
the employee must attend the class. Failure to do so will
be treated the same as an absence without notice. |
|
3.1.3 |
If the
teacher violates any of the items specified in this
agreement, ESL4Asia
will give the teacher up to two written signed warnings. If
no improvement is seen,
ESL4Asia will deduct NT$500
from the employee's salary for each infraction.
|
|
3.1.4
|
At the
discretion of the employer, the teacher may be granted
personal leave and be excused from the contract. |
|
3.1.5
|
In the
event a teacher’s request for leave of contract is granted
from the employer, no end of contract bonus payment shall be
payable to the teacher. The school will cancel the working
visa. |
|
3.1.6
|
In the
event of a teacher wishing to resign prior to the completion
of his/her contract period, a formal letter of resignation
shall be submitted to the employer not less than one months
before his/her last day of work which should be specified.
Under such circumstances, no end of contract bonus payment
shall be payable to the teacher. The school will cancel the
working visa. |
|
3.1.7
|
If for any reason less than
one
months notice is given, the end of contract bonus, as well
as funds in the trust fund will be forfeit. |
|
3.1.8 |
The employer may
if dissatisfied with the teacher’s performance, terminate
this contract prior to the end of the contract period with a
minimum of one months notice. Under such circumstances, no
end of contract bonus payment shall be payable to the
teacher. The school will cancel the working visa. |
|
3.1.9
|
In the
event of an act of gross misconduct being committed by the
teacher, ESL4Asia
may, at its discretion, summarily dismiss the teacher
without early notice. Under such circumstances, no end of
contract bonus payment shall be payable to the teacher. The
school will cancel the working visa.
|
|
3.1.10
|
In the event of
the teacher agreeing to and signing this contract, and then
leaving the school, he/she shall not pass on any information
relating to the school or it’s operations to which he/she
may become privy to during his/her employment. |
|
3.1.11
|
The teacher
agrees that, in the event of his/her leaving the employment
of the school, he/she shall neither defame nor make public
statements of a damaging nature concerning the school, or
it’s associated personnel. |
|
3.1.12
|
In the event
that said teacher leaves the employment of the school, the
teacher shall return all books and materials given to
him/her by the employer. Any materials not returned will be
charged to the teacher. |
|
4.1 |
Teacher’s Miscellaneous Responsibilities: |
|
4.1.1
|
The teacher will be responsible for:
A)
Personal insurance coverage that may be needed in addition
to the National Health Insurance plan. (I.e. travel, life,
and disability insurance)
B)
Transportation expenses in Taiwan
C)
Civil/criminal offences committed while residing in Taiwan.
|
|
4.1.2 |
Appropriate
clothing: temperature in summer (May-Sep) is about 30-35°
and winter (Dec-Feb) is about 10° with high humidity. |
|
4.1.3 |
The teacher may
experience cultural shock and unbearable weather conditions.
The school will provide assistance and guidance whenever
appropriate. It is in the teachers best interest to respect
the Chinese customs and observe Taiwanese laws. |
|
4.1.4 |
Suggestions or
comments regarding the managements
policies/curriculum/administration, etc. are most welcome
and appreciated. However, depending on the circumstances,
these might or might not be accepted for implementation for
various reasons. The teacher should commit to follow the
school’s policies and the principal’s guidance, and strive
to establish harmonious relationships within and without the
school during the contract period. |

5.1.1
Amendments:
|
This agreement
can be amended if both the school and the employee agree
upon new terms.
